Our family law mediation process involves 5 key stages:
Initiation
One party submits an application to request family law mediation and the other party is contacted in order to determine their interest in taking part. Issues to be discussed are collated and added to an agenda of topics to be covered during the negotiation process.
Selecting a mediator
Parties are presented with a list of suitable candidates depending on what specific areas they want to discuss during their negotiation. After a candidate is selected, a submission agreement is required to be signed by both parties.
Sessions
The sessions can take place in person or via a video or phone call at a pre-determined date, providing all parties have consented. Sometimes, only one session is necessary in order to reach as resolution as you never really know what’s possible until the discussion actually takes place. Prior to the beginning of the session, information will be requested by the supervising family mediator and both sides will present their issues for discussion. Using separate caucuses, the mediator can help both parties reach an agreement.
Settlement
Most of our sessions for family law mediation in Sydney will end with a settlement being reached that is agreeable to both parties. All parties must then sign an agreement that makes the agreement discussed enforceable under the law.
Impasse
If, for whatever reason, a settlement is not reached then parties are free to try an alternative method. Family mediation can always be reattempted at a later date.
